The company is considered a mediation company in the contracting of taxi services, for the purposes of the provisions of DECREE 314/2016, of November 8, which determines the specific conditions for contracting and marketing taxi services. taxi and the legal regime of mediation activity.

These Terms of Use (“conditions”) establish the rules that regulate the use by the passenger (“User”) of the services contained in www.eltaxi033.com (“Website”), property of TAXI SERVICES PROVIDER SL (“Company”).

For your convenience we have a version translated into different languages, but this version (in Spanish) is the only legally binding one.

ACCEPTANCE OF THE GENERAL CONDITIONS

Before you can access the services, both by phone and on the website, you must expressly accept these terms and conditions. If you do not accept these terms and conditions, you will not be able to access the services on the website.

By formalizing your service request through any of the service request channels available in the “Company”, you confirm that you have read, understand and accept these conditions. Furthermore, you confirm that you have the necessary legal capacity and authority to accept these general conditions on your own behalf and/or on behalf of your companions. Therefore, you must notify us of any modification or cancellation by you.

Acceptance of the “Conditions” will mean that you are legally bound to them. Therefore, WE PLEASE READ THESE “CONDITIONS” AND TERMS CAREFULLY before accepting them.

WITHDRAWAL

Both you and the “Company” may immediately terminate these “Conditions” and the services contained on the website without giving any reason.

The "Company" may modify these "Terms" at any time it deems appropriate. Modifications will be effective upon publication on the "Company" website and will be deemed accepted by the "User." Upon first use of the "Company" services through any of its channels, whether telephone or through the ElTaxi.App website and app, consent will be deemed granted.

By formalizing your reservation, you confirm that you have read, understand and accept these conditions, and you also confirm that you have the necessary legal capacity and authority to accept these general conditions on your own behalf and/or on behalf of your companions. Consequently, you will be responsible for making timely payments, you must notify us of any modification or cancellation, and you must, upon receipt of the reservation confirmation, inform other travelers.

PROVISION OF TELEPHONE SERVICE – CALL CENTER

The “Company” has a telephone service through several intermediation telephone numbers to put the “User” in contact with the “Supplier” Taxi Driver, the management of immediate services and pre-reservations 365/24 (with modification, cancellation, adaptation of the service) directly connected through operating stations with a plurality of taxi drivers, so that the “User” can connect as quickly as possible with the taxi driver who can carry out the transport.

SERVICES INCLUDED ON THE WEBSITE

To use ElTaxi 033 services, the "User" must register by providing identification information. The information must be true, accurate, and pertain to the "User." Only adults or minors with the authorization of their legal guardian may register.

Once registered, the User will have free, non-transferable access to the website, through which they can request a taxi. The website will contact the nearest taxi driver and provide the User's location. If the taxi driver accepts the request, the User's identification information will be sent to the driver. Once the taxi driver accepts the service, any anomalies (delays, no-shows, etc.) will be the sole responsibility of the driver.

The website provides an exclusive, free-of-charge intermediation service between the "User" and the taxi driver. Therefore, this exclusive service does not include any other services, and in particular: (i) internet connections (ii) contracting and payment for the transportation service (iii) passenger transportation contract between the taxi driver and the "User" (iv). For the purposes of filing a claim, the "User" will be provided with the taxi driver's details so that the relevant claim can be filed against them.

SERVICE PROVISION

The website is connected directly or through operating stations to a variety of taxi drivers, so that the "User" can connect as quickly as possible with the taxi driver who can provide the transport.

The mediation activity is limited to connecting the "User" with the taxi driver, and therefore does not contract any transportation services on its own behalf. Therefore, the "User" cannot be guaranteed that taxis will always be available to provide the requested service. Although ElTaxi 033 is expected to be in permanent operation, the "Company" does not guarantee the "User" that its availability will be uninterrupted.
